ATO Tax Debt and Home Loan Approval: What Creators Need to Fix First

Updated September 2026

An ATO tax debt does not automatically stop a home loan, but it has to be dealt with before you apply, because lenders will find it and most will not proceed while it is unmanaged. The debt shows up in your notice of assessment, your ATO account statement, or, for larger business debts, on your credit file. Some lenders accept a compliant payment plan, many want the debt cleared, and every lender treats an undisclosed tax debt as a reason to decline. The order that works is fix the debt, lodge everything outstanding, then apply.

At a glance

  • Lenders see tax debt through your notice of assessment, ATO account statement or credit file
  • The ATO can report business tax debts of $100,000 or more that are overdue by more than 90 days to credit bureaus
  • A payment plan helps with some lenders and not others; a cleared debt helps with all of them
  • Interest the ATO charges on late tax is no longer tax deductible, which makes carrying a tax debt more expensive
  • Fix the debt, lodge the returns, then apply; the other order rarely works

How a lender finds out

Creators sometimes assume a tax debt is private between them and the ATO. It is not, for three reasons.

Your documents show it. A full-doc application includes your notices of assessment and, with most lenders, an ATO income tax account statement or integrated client account statement. An outstanding balance, a payment plan and general interest charge accruals are all printed on those statements.

The ATO can report it. Since 2019 the ATO has been able to disclose business tax debts to credit reporting bureaus. The current criteria are that the entity has an ABN, has one or more tax debts totalling at least $100,000 that are overdue by more than 90 days, and is not engaging with the ATO to manage the debt. The ATO gives 28 days written notice before it reports. Once reported, the debt appears on your commercial credit file, and lenders check it.

Your bank statements show it. Payments to the ATO on a payment plan appear on the statements you have to provide. An assessor who sees regular ATO payments and no matching disclosure in your application has found an undisclosed liability, which is worse than the debt itself.

Never leave it off the application

Lenders can forgive a tax debt that is disclosed and managed. They do not forgive a liability that was hidden. Disclose every ATO balance, payment plan and unlodged return up front.

What a payment plan does to your application

A compliant payment plan changes the debt from an overdue liability into a scheduled one. That matters in two ways. It stops the ATO from reporting the debt to credit bureaus, because a compliant payment plan counts as engaging with the ATO. And it gives the lender a repayment figure they can put into the serviceability calculation like any other loan.

Lender treatment then splits. Some lenders will accept a payment plan that has been in place for a period, is being paid on time, and is fully disclosed, and will simply include the repayment in your expenses. Others will not lend while any ATO debt exists and will require evidence that it has been paid before settlement. A few will lend the money to clear the debt as part of the loan, usually at a price. Which camp a lender is in is policy, and a broker will know before the application goes in.

The strongest position is always a cleared debt with a receipt. If you can clear it, do, then apply.

The interest charge is now more expensive

From 1 July 2025, general interest charge and shortfall interest charge that the ATO imposes on late or underpaid tax are no longer tax deductible. Before that date, the interest was deductible, which softened the cost of carrying a tax debt. Now it is a pure after-tax cost, and the ATO’s interest rate is not cheap. Carrying a tax debt while you save a deposit is usually the worst of both worlds: the debt costs more than it used to, and it blocks the loan you are saving for.

If you have the choice between putting a windfall payout into a deposit account or into an ATO debt, the debt usually wins, both on cost and on lending position. The deposit article explains how to set tax aside on every payout so the debt does not arise in the first place.

Unlodged returns are a separate problem

A tax debt is a known number. An unlodged return is an unknown number, and lenders dislike unknowns more. If you have a return outstanding, the lender cannot see your income for that year, cannot see whether a debt will arise when it is lodged, and cannot complete a full-doc assessment. Most will decline or defer until it is lodged.

Lodging late is almost always better than lodging never. The ATO’s penalty for late lodgement is a fixed amount per period, and it is frequently remitted for a first offence or where there is a reasonable explanation. The cost of not lodging, in lost lending options and in the ATO’s own escalating compliance action, is much higher. National Accounts can bring multiple years of creator returns up to date and negotiate a payment plan for whatever results.

The fix-first sequence

  1. Get a full picture. Pull your ATO account statements through myGov or your tax agent so you know exactly what is owed and what is unlodged.
  2. Lodge everything outstanding. Returns and BAS. This turns unknowns into numbers and stops the late lodgement penalties compounding.
  3. Clear what you can. Use any available funds, including a windfall payout, on the debt before the deposit.
  4. Set up a payment plan for the rest. Do it before the ATO escalates, keep every instalment on time, and keep the plan letter.
  5. Set tax aside going forward. A separate tax account with GST and an income tax percentage moved on every payout prevents the next debt.
  6. Then apply. With a cleared or managed debt, lodged returns and clean statements, the lender is assessing a business that has its house in order.

The whole sequence often takes a few months. That is still faster than applying now, being declined, and then doing the same steps with a credit enquiry on your file.

Does a past tax debt follow you?

A debt that has been cleared does not sit on your credit file unless the ATO reported it while it was outstanding. If it was reported, the listing follows the credit reporting rules for commercial defaults and will be visible for a period even after it is paid, marked as paid. Lenders weigh a paid listing far more lightly than an active one, and a broker will explain the history in the cover note rather than letting the assessor discover it.

If the debt was never reported, which is the case for most creator debts below the reporting threshold, the lender only sees it through your ATO statements, and a cleared statement is a clean statement.

Common questions

Can I get a home loan with an ATO debt?

Sometimes. Some lenders accept a disclosed, compliant payment plan that has been paid on time; many require the debt to be cleared before settlement. An undisclosed tax debt will lead to a decline with every lender.

Does the ATO report tax debts to credit bureaus?

Yes, for businesses with an ABN that have tax debts of at least $100,000 overdue by more than 90 days and are not engaging with the ATO. A compliant payment plan counts as engaging. The ATO gives 28 days written notice first.

Is ATO interest tax deductible?

Not anymore. General interest charge and shortfall interest charge imposed from 1 July 2025 are not deductible. Interest charged before that date was deductible under the old rules.

Should I pay my tax debt or save my deposit first?

Usually the tax debt. It costs more to carry than it used to, it blocks or restricts lender options, and clearing it improves your lending position more than the same money in a deposit account.

Will unlodged tax returns stop my home loan?

For a full-doc loan, yes with almost every lender, because they rely on lodged returns and notices of assessment. Lodge the outstanding returns first; a low-doc lender may be an interim option while you do.
